Acceptance and Availability of the General Terms and Conditions

These General Terms and Conditions regulate the legal relationship derived from the contracting processes carried out between users or customers and the owner of the website stendio.eu, eCommProjects Internet S.L., who reserves the right to modify these conditions at any time in order to adapt them to legislative, jurisprudential developments or market practices.

By accepting these General Terms and Conditions, the customer declares that they are of legal age and have the necessary legal capacity to contract in accordance with the applicable legislation. In the case of contracting on behalf of a legal entity, the intervening natural person declares, under their own responsibility, that they have sufficient powers of representation.

Acceptance of these General Terms and Conditions shall be understood to have taken place at the moment the user uses the website or formalises the contracting of products or services, being bound by them. The General Terms and Conditions will be permanently accessible on the website and may be stored and reproduced by the user.

The user undertakes to make proper use of the website and not to use it to:

  • Disseminate unlawful, violent, discriminatory content, contrary to fundamental rights or that infringes on honour, personal privacy or one's own image.
  • Introduce computer viruses or carry out actions that may alter, damage, interrupt or generate errors in the systems or data of eCommProjects Internet S.L. or third parties.
  • Hinder access to the website for other users.
  • Infringe intellectual or industrial property rights.
  • Impersonate other users or third parties.
  • Engage in illegal, deceptive activities or those contrary to contractual good faith.

These General Terms and Conditions are governed by Spanish regulations and, in particular, by:

Modification of the General Terms and Conditions

eCommProjects Internet S.L. reserves the right to modify these General Terms and Conditions at any time, with the aim of adapting them to legislative, jurisprudential developments or market practices.

Modifications will not affect contracts already concluded and will enter into force from the moment of their publication on the website stendio.eu, being considered duly notified to users.

Description of Products and Services

The essential characteristics of the products and services offered through the website stendio.eu are described in each of the product sheets.

In particular, in the case of an online poster and print shop, clear information will be provided regarding the characteristics, format, dimensions and conditions of use of the products.

In the event that there are specific conditions applicable to a certain product or service, these will be duly indicated in their corresponding sheet or specific section and shall prevail over these General Terms and Conditions where applicable.

eCommProjects Internet S.L. takes the utmost care in the description and presentation of the products and services available on the website. However, in the event of typographical, formal or numerical errors, especially regarding prices, characteristics or availability of the products, these will not be binding on eCommProjects Internet S.L., and the company shall be authorised to correct them at any time.

In such cases, eCommProjects Internet S.L. will inform the customer as soon as possible, offering them the option to confirm the order under the correct conditions or proceed to its cancellation at no cost, with a full refund of the amounts paid.

Electronic Contracting Procedure

To place an order on Stendio, it will be necessary to carry out the following steps:

  • Choose your product (or products) on the website and click on "Add to cart" to add them to the order.
  • Open the shopping cart by clicking on the cart icon (at the top right) and then click on "Checkout" in the drop-down menu that appears.
  • On the "Order Summary" screen we can review the products to be purchased and we must click on "Checkout" again if we want to make the purchase.
  • Finally, we will have a final screen where we must fill in the delivery details, billing details, shipping method and payment method.
  • Once we fill in the information from the previous point on the "Purchase Process" screen, we will click on "Complete Purchase".
  • Depending on the chosen payment method, we might have to complete the payment on the payment gateway of the payment method or this step may not be necessary.
  • Finally, we will end up on a screen that will confirm our order and a copy of the purchase-sale contract and order summary will be sent to us by email.

Please note that if the payment is made by debit or credit card, the charge will be made as soon as the payment process is finished.

Price

In each of the product categories, their retail price appears, with taxes included.

In certain specific cases, the exact price to be charged to the customer may involve the payment of delivery costs, which are specified in the section referring to shipping; likewise, when viewing their basket once a product has been added, the customer will be able to have all the relevant information regarding delivery costs. In the event of a discrepancy between the price indicated for delivery costs in the corresponding section of the website and that indicated at the time of finalising the order in the basket, the one indicated at the end of the order shall always and in any case prevail.

Shipping

On Stendio, only products that we can deliver within a reasonable period may be purchased. The product sheet will indicate whether it is available or not.

Regarding shipping methods, delivery times and costs, the terms reflected in the corresponding section of our website shall apply.

The company will do everything possible to ensure that the transport companies meet the set deadlines; however, in the event that due to causes beyond the control of eCommProjects Internet S.L. these are breached, under no circumstances do we accept responsibility for the delay and therefore shipping costs will not be refundable.

The order shall be understood to have been delivered at the moment the delivery note appears signed in the systems of the courier company.

We are not responsible for any potential extra costs derived from customs.

Use of the Service and Responsibilities

eCommProjects Internet S.L. does not guarantee the permanent availability of the website or of the products and/or services offered, being exempt, to the extent permitted by current regulations, from any liability for damages that may derive from, including but not limited to: errors or omissions in the content, lack of availability of the website or products, or the transmission of viruses or malicious programs, despite having adopted reasonable technical measures to prevent them.

Likewise, eCommProjects Internet S.L. shall not be liable for delays or failures to comply with its obligations when these are due to circumstances of force majeure, in accordance with the provisions of the Civil Code, including, among others, strikes, industrial disputes, riots, terrorist acts, war conflicts, pandemics, fires, adverse weather phenomena or any other unpredictable or unavoidable circumstance.

eCommProjects Internet S.L. is not responsible for the content, actions or materials provided by users or third parties that could infringe intellectual or industrial property rights, business secrets, fundamental rights or any applicable regulations. In particular, it shall not be liable for damages derived from an illegal or improper use of the website.

Right of Exclusion

eCommProjects Internet S.L. reserves the right to deny or withdraw, without prior notice, access to the website stendio.eu to those users who breach these General Terms and Conditions or the applicable regulations.

Severability of Clauses

If any provision of these General Terms and Conditions were to be declared totally or partially null or ineffective, such nullity or ineffectiveness shall not affect the rest of the document, which shall remain fully in force, considering the affected clause as not placed in that which is invalid.

Applicable Regulations, Dispute Resolution and Jurisdiction

The relationship between eCommProjects Internet S.L. and the user shall be governed by current Spanish regulations.

In the event of a dispute, and when the user status is that of a consumer, the parties shall submit to the Courts and Tribunals of the consumer's domicile. In all other cases, unless otherwise provided by law, the parties submit to the Courts and Tribunals of León, expressly waiving any other jurisdiction that might correspond to them.

Submission of Complaint Forms

eCommProjects Internet S.L. has complaint forms available to consumers and users, which may be requested at the registered office of the company. Likewise, the user may submit claims through the competent consumer bodies in accordance with the regulations applicable in their place of residence.
